These Terms of Service (the “Terms”) govern your access to and use of the FanSpot website, applications, and services (collectively, the “Service”), operated by FanSpot (“FanSpot,” “we,” “us,” or “our”). By creating an account, purchasing a ticket, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
FanSpot is a platform that helps schools and other organizations (each an “Organizer”) sell tickets, promote events, and manage attendance, and that allows individuals (“Buyers”) to discover and purchase tickets to those events. FanSpot is not the organizer, host, or producer of any event and is not responsible for the events themselves.
You must be able to form a legally binding contract to use the Service. You are responsible for the information you provide and for all activity that occurs under your account. Keep your login credentials secure and notify us promptly of any unauthorized use. Organizer accounts may only be operated by individuals authorized to act on the organization’s behalf.
Ticket prices are set by the Organizer. FanSpot and its payment processor may add service or processing fees, which are disclosed before you complete a purchase. All payments are processed by our third-party payment processor, Stripe; by making a purchase you also agree to Stripe’s terms. FanSpot does not store your full payment card details. Purchases are charged in the currency shown at checkout, and all fees are non-refundable except as described in Section 4 or as required by law.
Refund and cancellation policies are set by the Organizer for each event and are shown at the time of purchase. If an event is canceled or materially changed, refunds are handled by the Organizer in accordance with that policy. FanSpot may facilitate refunds on an Organizer’s behalf but is not itself obligated to provide refunds. Service and processing fees may be non-refundable.
Organizers are solely responsible for their events, event listings, pricing, refund policies, tax obligations, and compliance with all applicable laws. Organizers represent that they have the right to sell tickets to the events they list and that their listings are accurate and not misleading.

A ticket is a limited, revocable license to attend the applicable event, subject to the Organizer’s and venue’s rules. Tickets may include a QR code or admission link that is valid for a single admission; duplicating, transferring, or tampering with a ticket may result in denied entry.
The Service, including its software, design, and content provided by FanSpot, is owned by FanSpot and protected by intellectual property laws. Organizers retain ownership of the content they submit and grant FanSpot a license to host, display, and promote that content in connection with the Service.
The Service integrates with third-party providers (for example, payment processing and analytics). We are not responsible for third-party services, and your use of them may be subject to their own terms and policies.
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, FanSpot will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid to FanSpot in the twelve months before the claim or one hundred U.S. dollars ($100).
You agree to indemnify and hold FanSpot harmless from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms.
We may suspend or terminate your access to the Service at any time if you violate these Terms or to protect the Service or its users. You may stop using the Service at any time.
These Terms are governed by the laws of the State of [STATE — to be confirmed by counsel], without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in that state.
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
